DEVOLUTION TO PANCHAYATS IN ASSAM : THE WAY FORWARD:

Statement of Conclusions arrived at between the Chief Minister of Assam and Union Minister of Panchayati Raj and Youth Affairs & Sports, on 12th September 2006 following the visit of the Union Minister to Assam from 9th to 12th September 2006.
       
Panchayati Raj in Assam: Current Status:

  1. Pursuant to the 73rd Constitutional Amendment Act 1992, Assam enacted the Assam Panchayat Act, 1994.  As envisaged under Part IX of the Constitution, the State Government of Assam constituted Panchayats at the District, Block and Gram levels and entrusted them with duties and responsibilities with a view to enabling them to function as institutions of self-government.
  2. The steps so far taken by the Government of Assam for empowerment of Panchayats at the Gram, Block and District levels include the following: 
    1. The Panchayats have been legally vested with powers and responsibilities as provided in the Panchayati Raj Act, which enable the State to transfer funds, functions and functionaries to PRIs in respect of 29 subjects in line with the 73rd Amendment of Constitution of India.
    2. Activity Mapping has been done in respect of 29 Departments and Government Notification has been issued to this effect on 26th July 2002. A High Powered Committee is constantly reviewing the steps taken by the Government Departments in order to ensure functional, fiscal and administrative devolution to the PRIs.  So far, 6 Departments have issued the necessary orders assigning functions and activities to appropriate tiers of PRIs. 
    3. The District Planning Committees have been constituted in all 20 Non Sixth Schedule districts.  A Cabinet Sub-committee has been constituted with Principal Secretary, Planning and Development as its Member Secretary, for finalizing the modalities in regard to the composition and strengthening the functioning of DPCs. The draft guidelines are being prepared and finalized.
    4. The Assam Panchayat Act, 1994 and the Rules made under the Act have made it mandatory on the part of the Gram Panchayat for convening periodic meetings of the Gram Sabha on a quarterly basis.
    5. The various provisions of the Assam Panchayat Act, 1994 and the rules enacted under the Act facilitate the imposing of taxes by the Panchayats.  Presently Gaon Panchayats are having share in land revenue, local rates, revenue earned from the settlement of HJAT, fisheries, House taxes, fines, penalties etc.  For the year 2005-06, the collection of taxes by Zilla Parishads, Anchalik Panchayats and Gaon Panchayats has been Rs.497.08 lakh, Rs. 21.22 lakh and Rs. 338.41 lakh respectively. 
    6. The State Government have urged the Zilla Panchayats to frame bye-laws under the provisions of the Assam Panchayat Act, 1994 for effective levying of taxes.  The Zilla Parishads of Nagaon and Jorhat have already framed the bye-laws and submitted the same for the approval of the State Government.
    7. The State Government have appointed State Election Commission to look into the matters related to preparation of Electoral Rolls, Delimitation of Constituencies, Rotation of seats, qualification of candidates, conduct of elections and adjudication of electoral disputes.
    8. The State Government have, in pursuance to the provisions of the Assam Panchayat Act, 1994, constituted the Third State Finance Commission under the Chairmanship of Shri Haren Das, IAS (Retd.), former Chief Secretary to the Government of Assam.
    9. The State Government have submitted the Block wise list of products and endowments to the Ministry of Panchayati Raj.  The State Government have further taken up the scheme of construction of Rural Market Sheds and SARAS Melas as steps for promoting Rural Business Hubs.  

Plan of Action: Government of Assam:

  1. DEVOLUTION OF POWERS AND FUNCTIONS
    1. A fresh national impetus has been given to the devolution of powers and responsibilities through the Seven Round Tables of State Ministers of Panchayati Raj, which arrived by consensus at 150 recommendations pertaining to 18 dimensions of Panchayati Raj. The Government of Assam will address itself to these recommendations and review the same regularly.

SUSTAINING THE PACE OF REFORMS
The challenges before Assam in sustaining the pace of reform will require effective support and close coordination with the Central Government. The Government of Assam and the Union Ministry of Panchayati Raj, agree to accord priority, in this endeavor, to the activities listed below

  1. ACTIVITY MAPPING
    1. The Activity Map prepared and issued by the State Government in the year 2002 needs to be updated.  The State Government has already instituted a mechanism for review of the devolution of functions, funds and functionaries to Panchayats on a continuing basis.  The State Government will undertake a review by November1, 2006 of the devolution made vide the Activity Map prepared in 2002 in order to make it meaningful to the Panchayats with the help of Ministry of Panchayati Rajand the revised Activity Map, backed by the required Government Orders, will be released by the Chief Minister in the presence of the Union Minister in December, 2006.  
    2. In fulfillment of the devolution of functions, funds and functionaries under the Assam Panchayat Act, Assam undertakes to complete this process and issue the necessary orders by the remaining Departments transferring schemes based on Activity Mapping. The State Government will issue Government orders in respect of the Activity Mapping so done in order to eliminate all ambiguities and doubts in respect to the devolution.  
    3. The Government of Assam will formally release the Activity Map so prepared and backed by the requisite Government orders.
  2. OPENING A PANCHAYAT SECTOR WINDOW IN THE STATE BUDGET : For effectively performing the functions devolved to them through Activity Mapping, the Panchayats would need a matching transfer of funds for the devolved functions which will be clearly provided in the State Budget commencing 2007-08. 
  1. TRANSFER OF FUNCTIONARIES
    1. The State Government will transfer all such functionaries in accordance with the transfer of functions and finances to Panchayats at all levels. The functionaries required to implement schemes entrusted will also be placed at the disposal of the Panchayats concerned.
    2. The State Government further affirms that the functionaries will be transferred to the Panchayats in respect of the subjects devolved with full functional, administrative and disciplinary controls. 
    3. The State Government will frame Rules for Panchayat based Cadres of technical and other support services recruited at the Panchayat level.
  2. TWELFTH FINANCE COMMISSION GRANTS FOR PRIs
    1. The State Government will release the 1st instalment of the 12th Finance Commission grants for 2005-06 to the Panchayats with the approval of high-level committee.
    2. The State Government will also provide the allocation details upto Gaon Panchayat level and the details of release of the 1st instalment to the Ministry of Finance for securing release of the 2nd installment of 2005-06. 
    3. The 1st instalment of the 12th Finance Commission grants for the year 2006-07 has also become due with effect from 1st July 2006.  The State Government will submit a request for release along with the necessary certificates of release for the previous installment.
    4. Block grants released by the Central Government on the recommendations of the 12th Finance Commission will be released within fifteen days from the date of approval of high level committee from the Consolidated Fund of the State to all Panchayats in accordance with the recommendations of the State Finance Commission as mandated under Article 280 of the Constitution. For this purpose, the Government of Assam will endeavor to put in place a system of direct credits to Panchayat bank accounts at all levels from the Treasury. The Fund Transfer Monitoring Software developed by NIC unit of Ministry of Panchayati Raj would be utilized for this purpose.  Relevant details regarding release of the grants to PRIs would also be made available to AG for effective test check by C&AG.
  3. TRANSFER OF FUNDS:
    1. For all Panchayats to effectively plan and implement the functions that have been devolved upon them, it is necessary that funds pertaining to these schemes are transferred to them “without delay or diversion”, as provided for in the National Common Minimum Programme.
    2. As part of this process, the Government of Assam agrees to put in place systems that are capable of tracking transfers of funds to Panchayat bank accounts, both through Banks and State Government Treasuries, preferably electronically.
    3. All Gaon/Anchalik Panchayats do not have banking institutions capable of electronic transfer.  In such a case the State Government will use the existing non-electronic transfer facilities of the banks.
  4. CAPACITY BUILDING OF ELECTED PANCHAYAT REPRESENTATIVES
    1. Elections are scheduled for PRIs in early 2007. It is likely that a large number of new representatives will be elected to the Panchayats.  The State Government undertakes to prepare a training plan in advance for all the Panchayat representatives keeping in view the guidelines of the Ministry of Panchayati Raj, Government of India and to commence activities like Training of Trainers (ToT), finalization of course material, preparation of training calendar etc.  This Action Plan will be submitted to the Government of India by December 1, 2006.
    2. The State Government undertakes to complete the training of all Elected Panchayat Representatives within a period of 6 months of their election.
    3. The effective and transparent functioning of Panchayats depends to a large degree on the frequency and quality of participation of all elected members in activities of the Panchayats. This is best done through strengthening Standing Committees at the Panchayat level, which are given a degree of flexibility and are held accountable for the performance of specific assigned functions. Assam undertakes to take up training programmes for Standing Committees constituted under the Assam Panchayat Raj Act, which will be oriented to the responsibilities of the Committees concerned. The district and sub-district level functionaries will be entrusted with the responsibility for the hands-on training of members of the Standing Committees.
    4. The Government of Assam will issue the required instructions to Deputy Commissioners/CEOs and all line department officers concerned to undertake the training of members of relevant Standing Committees of the Panchayats at all three levels to thoroughly familiarize elected representatives with all issues pertaining to the district/Taluka/village of their respective jurisdictions. 
    5. The State Government will develop 4 Regional Training Institutions in the State namely in the lower Assam, upper Assam, middle Assam and the hilly regions of the State with the assistance of the Government of India.
    6. The training imparted will be in the local language of the region. 
    7. The State Government will also make provision for continued training of the Panchayat members by the existing staff, technical staff and the subject matter specialists from the district.
    8. The successful Panchayats or those Panchayats which have distinguished themselves in some field will be turned into training institutions in respect of that field on account of the recognition and peer pressure for emulation that it is likely to bring. 
    9. The training schedule will also include IT enabled training in e-governance to the office bearers of Panchayats.  Some youth nominated by the Panchayats will be specially trained in IT application and encouraged to accept outsourcing form the Panchayats and others. 
    10. The State Government will develop satellite-based training by establishing a satellite application centre in the State with the assistance of the Ministry of Panchayati Raj, Government of India. 
    11. The State Government will to extend the training to the VIth Schedule Areas with a view to fulfill its constitutional obligations. 
  5. STRENGTHENING OF THE GRAM SABHA
    1. The State Government will take steps to constitute at the Gram Panchayat level, diverse sub-Committees of the Gram Sabha dealing with subjects listed in the Eleventh Schedule of the Constitution including matters such as education, health, midday meals, women and child welfare, agriculture, animal husbandry and PWD works. These sub-Committees of the Gram Sabha will be harmonized with the Gram Panchayat to facilitate an organic linkage and synergy between them, to ensure smooth functioning.  
    2. There is a felt need to involve Panchayats at all levels in providing effective and comprehensive first response in times of calamities or crisis. Government of Assam will formulate and develop a policy in this respect.
    3. Gram Sabhas will be strengthened, through providing them powers in the legislation and rules made there under with respect to
      1. Selection of beneficiaries,
      2. Approval of plans, programmes and schemes,
      3. Authorization of utilization certificates and
      4. Conduct of social audit.
    4. There is a need for constituting Sabhas below the Gram level at the Ward level with the objective of deepening peoples’ participation in local decision-making. The Government of Assam will examine the modalities of implementing this system, keeping in mind best practices from other States. It will take action accordingly for the constitution of Ward or Palli Sabhas below the Gram Sabha and incorporate the same in the Assam Panchayat Act, 1994 through suitable amendment.
    5. In order to build capacity and leadership among Elected Women Representatives of Panchayats, the State Government would consider favourably, extending the period of the reservation cycle from one to two or more terms.
    6. A compendium of the Panchayati Raj legislation and rules and all important circulars and instructions would be prepared in the local language and widely circulated among all elected representatives of Panchayats and officials.
    7. The State further undertakes to develop  a new administrative operating system for the Panchayats based upon the devolution of functions, funds and functionaries and for which it will develop the following manuals for the Panchayats :
      1. Budget Manual
      2. Accounts Manual
      3. Audit Manual
      4. Procurement Manual
      5. Office Management System
      6. Management Manuals for transferred institutions
      7. Public Works execution Manual
      8. Fiscal Responsibility Legislation for the PRIs.
  6. STRENGTHENING THE ACCOUNTING AND AUDIT SYSTEM OF THE PANCHYATS
    1. Considering the resolve of the State Government to devolve untied funds to the Panchayats, there is a need to strengthen accounting and auditing, including social audit at the Panchayat level.  The following steps will be taken in this regard:
      1. As recommended by the Committee in the Resolution of the Sixth Round Table of Panchayat Ministers at Guwahati in November, 2004, Assam will consider setting up an Audit Commission for local governments.
      2. Steps will be taken for a one-time updating of accounts of all Panchayats.
      3. New Budget Manual and Accounts Manual will be formulated and released.
      4. Steps will be taken to restructure the existing Performance Audit system into an effective concurrent audit system.
      5. Social audit will be strengthened and operational models of social audit developed and disseminated.
  7. CREATING COMPETETION AMONGST THE PANCHAYTS
    1. With a view to promoting healthy competition amongst the Panchayats the State Government will consider to identify ‘beacon’ Panchayats and awarding ‘Swaraj’ Trophies to them, for excellence in performance at all levels.
    2. A Committee comprising the Panchayat members, Members of Legislative Assemblies and Councils and experts from other walks of life will be set up to identify and institutionalize the best practices developed by the Panchayats.
  8. ELECTIONS TO THE PANCHAYATS
    1. Although after enactment of the Assam Panchayat Act, 1994, elections to the Panchayats could be held only in the year 2002, the Government of Assam will take steps to hold the next Panchayat elections in time.
    2. The State Government will endeavor that that forthcoming elections to the Panchayats are conducted with EVMs and on common Electoral Rolls as the last Assembly Elections.
  9. PANCHAYAT MAHILA SHAKTI ABHIYAN
    1. The State Government will promote the Panchayat Mahila Shakti Abhiyan of the Ministry of Panchayati Raj by identifying a lead NGOs.  The lead NGO will, with the assistance of the State Government identify a Convener for each district from amongst the EWRs of Panchayats in the districts.  A State level preparatory conference of these Conveners and academics and practitioners will be organized to draw up a Draft Charter. 
    2. A conference of the Elected Women Representatives and such lead NGOs will be organized, which inter alia, will draft a Charter for the Elected Women Representatives.
    3. The Charter will be discussed and adopted with suitable modifications in the meeting of Elected Women Representatives of Gaon Panchayats organized at the Anchalik level.
    4. Similarly conclave of Elected Women Representatives of Anchalic Panchayats will be organized at the district level to adopt the Charter so prepared.
    5. A Conference of Elected Women Representatives of the Zila Panchayats organized at the State level will adopt the Charter at the State level.
    6. The Charter so adopted will be discussed at the national level by  the Elected Women Representatives and a common Charter will be adopted for presentation to the Government the date for this would be in June 2007 i.e. a few months after Panchayat elections.
    7. The Elected Women Representatives at the above levels will meet regularly thereafter to implement the Charter and to pursue their common objectives. 
  10. PANCHAYAT YUVA SHAKTI ABHIYAN
    1. The State Government will organize a meet of the Elected Panchayat Youth Representatives below the age of 35 and the Youth Clubs of Nehru Yuva Kendras on the same pattern as in the case of the Mahila Shakti Abhiyan at Anchalic, District and the State levels to adopt Charter of Demands.
    2. The Charter of the Youth so prepared will be discussed and adopted at the national level in a conference of the Elected Youth Representatives of the Panchayats.
    3. The Elected Youth Panchayat Representatives will meet regularly to pursue the objectives in the Charter adopted by them. 
  11. PANCHAYAT YUVA KHEL  ABHIYAN
    1. The State Government endorses the concept of the Panchayat Yuva Khel Abhiyan of the Ministry of Panchayati Raj and adopts the same for implementation in the State in anticipation of being a Centrally Sponsored Scheme.
    2. The State Government undertakes to sponsor a Sports meet for the youth under the aegis of the Panchayat Yuva Khel Abhiyan of the Ministry of Panchayati Raj after conducting meets first at the village and Anchalic levels. 
  12. BACKWARD REGION GRANT FUND
    1. The State Government will complete Activity Mapping, creation of Panchayat Sector window in the Budget and complete village, Block and District level plans through DPCs for the BRGF districts.
    2. The State Government will submit proposals for release of funds under the Backward Region Grant Funds in respect of the districts covered under the erstwhile Sam Vikas Yojna of the Government of India.
    3. In respect to rest of the districts newly inducted into the programme the State Government will take advance action for preparation of the proposal and submit the same by November 1, 2006.
  13. RURAL BUSINESS HUBS
    1. The State Government will furnish progressively but as soon as possible complete lists of RBH activities proposed to be undertaken in each Anchalik Panchayat of the State.
    2. The State Government will set up the Rural Business Council at the State level.
    3. The State Government, in consultation with the Ministry of Panchayati Raj will involve the Confederation of Indian Industries and such other business houses, as it deems proper.
    4. The State Council of the Rural Business Hub will arrange to have 50 MoUs signed in People-Private-Public-Panchayat Partnership (P5) mode by March 2007 as endorsed by the Ministry of Panchayati Raj.
  14. ACCOUNTABILITY OF THE PANCHAYATS: With a view to strengthen the system of accountability of the Panchayats, the State Government will take the following steps:
    1. Fully implement the Right to Information Act in   letter and in spirit.
    2. Prepare a Citizen’s Charter in consultation with Panchayats at all levels.
    3. Prepare and publish an annual State of the Panchayats Report.
    4. Fiscal Responsibility Legislation will be put in place.  
  15. NATIONAL RURAL EMPLOYMENT GUARANTEE ACT : The State Government will operationalise in letter and spirit the NREGA involving Panchayats as the principal authorities for planning and implementation.
  16. DISTRICT PLANNING
    1. The State Government undertakes to put in place District Planning Committees (DPCs) following the procedures prescribed under Section 3 of the Assam Panchayati Raj Act, 1994 by October 1, 2006.
    2. In view of the Planning Commission’s circular of 28 July 2006 advising that the Eleventh Five Year Plan and all Annual Plans in the Eleventh Plan Period commencing April 2007 will be based on district development plans prepared in conformity with the provisions of Article 243 ZD of the Constitution, detailed operational guidelines will be issued by October 2nd 2006 to District Planning Committees.
    3. In pursuance of Article 243 ZD of the Constitution, detailed operational guidelines will issue by October 2006 to enable Gaon Panchayats, Anchalik Panchayats, Zilla Parishads and Municipal Bodies to prepare their respective draft development plans by November 2006 so that by mid-December 2006, District Development Committees are able to consolidate these plans into the Draft District Development Plan.  The Plan Discussions with the States are to commence in the Planning Commission from October, 2006.  This will ensure that Assam engages in a genuinely participative, bottom up planning process through all local bodies for the 11th Five Year Plan, commencing with the Annual Plan for 2007-08, in pursuance of the advice of the Planning Commission.
    4. It was also noted that BRGF releases are contingent upon the submission of District Plans for the Districts concerned. 
    5. With respect to the subjects devolved to the Panchayats, steps will be taken to merge all parallel bodies including District Rural Development Agencies (DRDAs) with Zilla Parishads by January 1, 2007 so that the Panchayats acquire an appropriate instrumentality for planning. 
  17. SIXTH SCHEDULE : With respect to Sixth Schedule areas, in the context of BRGF and the 11th Five Year Plan, an Expert Committee constituted by the Union Ministry of Panchayati Raj will shortly visit Assam to discuss arrangements with the Assam Government and other States comprising Sixth Schedule Areas.  Thereafter, arrangements will be finalized at a Conference of Chief Secretaries followed by a meeting in Shillong of the Chief Ministers concerned.
  18. GENERAL
    1. The State Government will consider to start a Newsletter for the Panchayats in consultation with the Ministry of Panchayati Raj and the National Book Trust, New Delhi.
    2. The State Government will prepare a plan for capacity building, infrastructure development, IT enablement, institutional growth, health, sanitation, education, agricultural and irrigation development and seek support from the appropriate agency for the same with the assistance and support of the Ministry of Panchayati Raj.

Plan of Action: Government of India:

    1. The Union Ministry of Panchayati Raj agrees to support the Government of Assam with technical assistance in undertaking further Panchayati Raj reform including Activity Mapping and Fiscal Devolution. 
    2. The Ministry of Panchayati Raj undertakes to support and assist the endeavour of the State Government to prepare and  secure funding assistance for strengthening delivery mechanism of Panchayats on the same pattern as Karnataka.
    3. The Union Ministry of Panchayati Raj will pursue the establishment of a capacity and infrastructure development window – Gram Swaraj - so as to provide support to Panchayats to strengthen their administration.
    4. The Union Ministry of Panchayati Raj shall assist the Government of Assam in capacity building and training of elected representatives and officials of Panchayats.  This could include support to the SIRDs and Extension Training Centres (ETCs) for faculty, resource persons for training, trainers, officials, and exposure visits for Panchayat Members.
    5. The Union Ministry of Panchayati Raj will assist the Government of Assam to set up a distance learning facility for Panchayati Raj elected representatives and officials through satellite communication.
    6. The Union Ministry of Panchayati Raj (MoPR) undertakes to assist the Government of Assam in creating awareness about the significance of Panchayati Raj among the youth and the student community, women, aspirants to office in Panchayati Raj Institutions and elected representatives. To this end, MoPR would assist in conducting orientation and training of persons aspiring to posts in Panchayats, particularly youth and women, through pre-election voter education campaigns.
    7. The Union Ministry of Panchayati Raj shall support the development of Rural Business Hubs (RBHs) through Public-Private-Panchayat Partnerships, so as to upgrade local skills, identify and promote products, and locate markets for these products. Strenuous efforts will focus on RBHs in the sectors of rural tourism, organic farming, food processing, handicrafts, horticulture, floriculture, biodiesel, micro-hydel and other renewable energy technologies.
    8. The Union Ministry of Panchayati Raj agrees to support initiatives in computerization and e-governance of Panchayats in Assam, as part of the National e-Governance Action Plan.
    9. The Union Ministry of Panchayati Raj undertakes to provide technical assistance to Assam to build capacity of Panchayats to undertake the obligations of the recording and preserving of bio-diversity in their areas, as mandated by the National Biodiversity Act. Capacity building will also cover environmental and spatial planning at the Panchayat level.
    10. The Ministry of Panchayati Raj will pursue the devolution of Central funds through untied block grants and systemic reform of Centrally Sponsored Schemes, including the establishment of a Panchayat Empowerment Incentive Fund to conform with provisions on good governance at District, Anchal and Village levels as set out in Part IX read with the relevant articles of Part IX A of the Constitution of India.
    11. The Ministry of Panchayati Raj will assist the State Government in the modalities of maintaining a data base of Panchayat bank accounts and monitoring the transfer of funds from the State Treasuries to these accounts without delay or diversion.
    12. The Ministry of Panchayati Raj will assist and support the State Government to publish a Newsletter for its Panchayats.
    13. The Ministry of Panchayati Raj will assist and support the Yuva Shakti Abhiyan to be undertaken by the State Government by providing funding,  technical and cultural support and will link the same to the Yuva Shakti Abhiyan at the National level.
    14. The Ministry of Panchayati Raj will assist and support the Mahila Shakti Abhiyan to be undertaken by the State Government by providing funding, technical and cultural support and will link the same to the Mahila Shakti Abhiyan at the National level.
    15. The Ministry of Panchayati Raj will assist and support the Sports programme for the Panchayat youth for the State of Assam and the Minister Panchayati Raj, Government of India will attend the final programme at the State level.
    16. Owing to contractual arrangements between the State Governments and Tea Estate Management which pre-date the creation of Panchayats, there is a certain lack of co-ordination between the Tea Estate Management and Panchayats in these areas with regard to service delivery of health, education, electricity etc.  With the consent of the State Government, the Ministry of Panchayati Raj agrees to set up an Expert Committee to study these issues and to recommend solutions.
    17. The Ministry of Panchayati Raj will interact on regular basis with Central Ministries in-charge of programmes like Sarva Shiksha Abhiyan, Mid –day Meal scheme, National Rural Health Mission, ICDS etc to have the centrality of Panchayats incorporated in their guidelines. The State Government undertakes to make the corresponding changes in the institutional mechanism at the State level. 
    18. The Ministry of Panchayati Raj will pursue the creation of Panchayat Empowerment Incentive and Accountability Fund through which it undertakes to provide additional funds to the State  Government based on the progress in the areas of Activity Mapping, creation of a Panchayat Sector window in the State Budget, District Planning through DPCs and devolution of functionaries to Panchayats.  The funds will also incentivise the Panchayats to follow transparent procedures of audit, monitoring, Gram Sabha approval and social audit so as to strengthen the accountability of Panchayats at all levels.
    19. (a) For release of TFC grants, the state High Level Committee meeting will be held within 15 days of the receipt of the release of the installment by the GOI and funds to PRIs will be released by ceiling within 15 days from the approval of high-level committee. (b) Taking in to account the normal long time in collecting expenditure statement from the large number of PRIs and submission of UCs to GOI by the state government, it is agreed that GOI will not withhold the release of any installment of the Central fund till submission of the UCs.

This (a+b) is a special dispensation being sought by the state government in view of prevailing ground realities in the state subject to the approval of the Department of Expenditure.
